Retirement benefits, like other assets are divide between the parties if they were accumulated during the marriage.   If both parties have benefits, then the benefits are off-set against each other.  Often times it is difficult to get an amount of a retirement account at the time of marriage to determine the premarital portion.  If there is a premarital portion, it is subtracted from the total to get the marital portion.

Social Security Benefits are not divided.  The federal government grants you your benefits or an amount of one-half of your spouses benefit during the marriage.  You make the election.  It doesn’t effect the parties benefits by reducing them.  You must be married for ten years to get this benefit.
